The licensing inspector conducted an unannounced complaint inspection in response to a complaint received by the department on 12/10/2021 regarding ratios and the supervision of children. On 01/19/2022, the inspector was on site from 11:25am to approximately 12:53pm. Interviews were completed, observations were made at the center, and documentation was reviewed. The preponderance of the evidence gathered during the investigation supports the allegations, therefore the complaint is determined to be valid. Any violations not related to the complaint, but identified during the course of the investigation can be found on the violation notice.

Standard #: 8VAC20-780-350-C Complaint related: No Description: Based on information obtained during interviews on 01/19/2022, the center did not ensure that when children are regularly in ongoing mixed age groups, the staff-to-children ratio applicable to the youngest child in the group shall apply to the entire group.
Evidence: 1) During interview, staff reported Classroom #1 is the opening classroom for children ages two to four years old. The children are regularly combined daily each morning until additional staff arrive at 7:30am. 2) The staff interviewed reported that on an average three days a week Classroom #1 was out of ratio in the morning because staff arrived 10-15 minutes after their scheduled time. 3) The staff interviewed reported that some days, for approximately 10-15 minutes, there have been up to 11 children in Classroom #1 in the direct care of one staff member with the youngest child being 2-years-old. The applicable staff-to-child ratio for two-year-old children is one staff member for every eight children.Plan of Correction: Corrected. During the months of November and December 2021, the center provided services to families based on the time children would arrive and based on the number of staff members available in order to stay within the required ratios. Additional staff have been hired and classrooms are closed when there are no sufficient staff to cover classrooms.
