Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Discussed playground safety checks for potential injury hazards such a open hooks on swings, pinch points, dangling cords and trip hazards that can occur when ground is uneven with patio.

Comments:
An unannounced inspection was initiated on 06/24/2024 and completed on 07/17/2024 in response to complaints received by the licensing office on 04/25/2024 and 05/13/2024 relating to allegations in the areas of staff-to-child ratio, supervision of children, reporting of suspected child abuse and ensuring all areas of the previses are free of obvious injury hazards.

The inspection included:
*Document review - written policies and procedures;
*Tour of the facility and outdoor play area:
*Interviews with staff;
*Observations.

The preponderance of evidence gathered during the investigation supports the allegation in the area of obvious injury hazards and this part of the complaint is found to be valid. A violation of 22.1-(14.1)-289.031-B-5 is documented on the violation notice issued to the program.

The preponderance of evidence gathered during the investigation does not support the allegations in the areas of staff-to-child ratio, supervision of children and reporting of child abuse therefore, these allegations are determined to be not valid.

Description: Based on observation, the religiously exempt child day center failed to ensure that all areas of the premises accessible to children are free of obvious injury hazards, including providing and maintaining sand or other cushioning material under playground equipment.

Evidence:
1. There was no cushioning material under any of the outdoor play equipment when the playground was reviewed on 06/24/2024.

Plan of Correction: Administrative staff stated that much had washed away with all of the rain. A new load of much has been ordered and due for delivery within the next few days.
Mulch was delivered and placed under all outdoor play equipment on the afternoon of the inspection - 06/24/2024.
