This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A complaint inspection was initiated on October 28, 2020 and concluded on October 29, 2020. A complaint incident was received by the department regarding allegations in the areas ratios, food services, and forbidden actions. The director was contacted by telephone to conduct the investigation.
The preponderance of the evidence gathered during the investigation does support at least one allegation; therefore, the complaint is determined to be valid. The licensing inspector and director reviewed guidelines for operation during the state of emergency.
Provider, please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the violation notice and return it to me within five business days from date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).
Based on information obtained during the inspection, the center did not ensure staff to children ratio requirements applicable to the youngest child in the group were followed when children were regularly in mixed age groups. Evidence: 1. During an interview with the licensing inspector on 10/28/2020, the director stated the three year old class, four year old class, and school age class are in a regular and ongoing mixed age group during the last hour of operation. 2. The licensing inspector spoke with the director about the class ratio in the mixed age group and the director stated that the ratio was determined by doubling the ratio applicable to the youngest child in the group. The director stated a belief that ratios could be doubled during the first and last hours of operation. The director stated the center's regular supervision was based on a belief that in a regularly mixed age group where three year olds are in care, that the correct ratio would be 1:20 during the first and last hours of operation. 3. During an interview with the licensing inspector, a staff member reported an estimated daily ratio of 1:18 in the mixed age group consisting of the three year old class, four year old class, and school age class. 4. During interviews with staff members, it was reported that the three year old and four year old classes regularly join the school age class at approximately 5:30 PM each day.
When children are in a regularly ongoing mixed age group, the staff-to-child ratio applicable to the youngest child in the group shall apply to the entire group. In a regularly ongoing mixed age group consisting of three year olds, four year olds, and school age children, the ratio should be 1:10.
