Comments:
A complaint regarding supervision, documentation, self-reporting and behavior guidance was received on June 4, 2019. The complaint was initiated on the same day. The investigation concluded on August 9, 2019. During the investigation staff and a child's record were reviewed. Additionally, staff were interviewed. The information gathered during the investigation partially supports the allegation. Therefore, the complaint is valid. Violations regarding center policy and behavior guidance were identified during the investigation and appear on the violation notice.
Based on policy review and interview the center failed to ensure that operation responsibilities of the licensee include, but not be limited to, ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures. Evidence: 1 - On March 1, 2019 staff 2 was given a "final written warning" stating that she "did not follow the Positive Guidance and Redirection Policy for interacting with children. She used an improper tone of voice and poked a child as redirection." a. The center's policies state that "No staff member is permitted to use physical...punishment on any child...in our care in any way. Staff members are prohibited from using the following as means of punishment or redirection...a....pulling, pushing, physical force....k. Any other form of physical abuse, emotional abuse, or neglect."

Description:
Based on interview and record review the center failed to ensure that physical punishment, roughly handling a child, or threats there of are forbidden. Evidence: 1 - Documentation confirmed that on February 18, 2019, staff 2 "poked a child as redirection." 2 - During interview with staff 2 she stated that she did not realize "how roughly she touched the child until she viewed video tape." a. Staff 2 stated that if she had been a parent seeing the interaction, it would have been upsetting.
