Comments:
A self-reported incident was received and initiated on April 25, 2022, regarding a child left on the center playground. An onsite investigation was conducted on April 25, 2023. During the investigation staff were interviewed and staff and children records were reviewed. Based on the information gathered during the investigation, the self-reported incident is determined to be valid. Violations are cited on the violation notice and were discussed with center management at the conclusion of the investigation.

Standard #: 8VAC20-780-40-E
Description: Based on interview the center failed to demonstrate operational responsibilities ensuring that the center's activities, services, and facilities are maintained in compliance with the center's own policies and procedures.
Evidence:
1 - The center's policies states ?face to name means staff must see the child's face and say the child's name when confirming all children are accounted for throughout the day? and ?line children up for the transition, confirm you have seen the child's face and said their name by putting a check mark in the row associated with their name before leaving? the policy was not followed leading to a Child #1 being left unattended on the toddler playground by Staff #2 and #3.
a. Staff #2 stated that she when she filled out the face-to-name she mistakenly checked off Child #1?s name because she was looking at another child in the class that looked just like Child #1.
b. Staff #2 stated that the children did not line up on the wall before entering the building nor did she count and check faces.
c. Staff #3 stated she was carrying two children that were not yet walking independently. Additionally, another child ?had wondered away from door,? she had to go get that child. Once back at the door she ?continued counting children,? but ?Child #1 must have gone back to the play castle.?
2 ? Staff #1 stated that upon viewing video footage of the child left on the toddler playground she was able to confirm that Child #1 had been left on the playground for approximately four minutes

Description: Based on interview the center failed to ensure that children under 10 years of age always shall be within actual sight and sound supervision of staff.

1 ? On April 25, 2022, 18-month-old Child #1, was left unattended on the toddler playground for approximately four minutes.
a. Staff #1 stated Child #1 was left unattended on the playground for approximately four minutes by Staff #2 and #3.
b. Staff #2 stated that she wrongly identified another child as being Child #1 resulting in Child #1 being left unattended on the playground.
c. Staff #3 stated that she became aware that Child #1 had been left unattended on the playground when Staff #1 told her the child had been left some time later.
