An unannounced non-mandated monitoring inspection in response to a self-reported incident regarding behavior guidance was conducted on-site April 11, 2024 and concluded remotely May 9, 2024. The director was available during the inspection. The inspector reviewed compliance in the areas of administration and programs. Documentation was reviewed and interview conducted.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.
Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.
Repeat Violation Based on a review of records, the licensee failed to ensure that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department. Evidence: 1. On page 2 of the center's policy titled 'Guidance, Protection of and Respect for Children,' regarding behavior guidance, it states "Employees are expected to use a calm, caring, and gentle tone of voice and to never use a harsh tone of voice. Any statement that is derogatory or insulting is unacceptable." 2. Staff #1 self-reported yelling at child #1 to administration of the center. A witness to the yelling also reported staff #1 told a crying child to "go ahead and cry."

Description:
Based on interview, the center failed to ensure behavioral guidance is constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and result conflicts. Evidence: On April 10, 2024, staff #1 "yelled" at child #1, "I'm asking you to put it in the bag, I'm not picking it up again. I helped you the first time, I'm not helping you again, " and staff #1, using an elevated voice, told a child, "go ahead and cry."
