Technical Assistance:
Technical assistance was provided in the following areas of the standards: 22VAC40-191 (Background checks); 22VAC40-185-(4)-280 (Hazardous substances); 22VAC40-185-(4)-330 (Play areas)

Comments:
An unannounced monitoring inspection was conducted on 11/14/19 from 9:15am - 10:30am. During the inspection there were 28 children ages three months old through five years old in care with six staff. Children were observed participating in various activities in the classrooms and eating breakfast. Records were reviewed for five children and seven staff during the inspection. Medication, emergency procedures and emergency supplies were reviewed during the inspection. Areas of non-compliance are identified on the violation notice and were discussed during the exit interview.

Violations:
Standard #: 22VAC40-185-350-E-4
Description: Based on on observation and interviews, it was determined that the licensee did not ensure that for children, from three years old to the age of eligibility to attend public school one staff member for every 10 children is maintained at all times children are in care.

Evidence:
1. Staff #2 was working with a group of 11 Preschool age children in the cafeteria. The children present were ages four to five years old, so the facility was not maintaining the required 1 staff for every 18 children.
2. Staff #5 (Program Director) moved one child to another classroom upon arriving at the facility.
3. Staff #5 (Program Director) confirmed that the facility did not maintain the required staff-to-child ratio during the inspection.

Plan of Correction: The facility responded: We will review with our the teachers the correct staff-to-child ratios and instruct them what to do when they have to many children.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on a review of five staff records, it was determined that the facility did not ensure that an employee is allowed to begin employment without a completed national criminal history record check (finger printing).

Evidence:
1. The record for staff #1 (date of hire 9/11/19), working during the inspection, did not contain documentation of a completed national criminal history record check (finger printing).
2. Staff #5 (Program Director) reviewed the record for the staff #1 and confirmed that she had not received the results of the finger print background check (finger printing) prior to her beginning employment.

Plan of Correction: The facility responded: Staff #1 completed a finger print background check, but we never received the results, so we did another one which just came back on 11/12/19. New employees will not be allowed to work until a completed finger print background check is received..
