Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on April 7, 2021 and concluded on April 7, 2021. The administrative director was contacted by phone to initiate the virtual inspection. There were thirty-five children present with four staff and two administrative staff present. The inspector emailed the administrator a list of items required to complete the inspection. The inspector reviewed three children?s records and three staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined there were non-compliances with applicable standards or law and a violation was documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 63.2(17)-1720.1-B-4
Description: Based on a review of three records for staff, and an interview with administrative staff, the center failed to obtain all required out of state background checks for any state an individual lived in within the five years prior to the first date of employment. Evidence: According to the record, staff member 2 began employment on August 22, 2020. Staff member 2 named one state resided in during the previous five years on a sworn disclosure statement completed on August 20, 2020. There was not a finding from a sex offender registry check from that state prior to employment in the staff file. Also, there was not a copy of the request from that state within the first thirty days of employment for a child abuse registry check and an out of state finding due forty-five days after the request. During the virtual inspection, the administrative staff verified with staff member 2 the time period was less than five years prior to initial employment.

Plan of Correction: The administrative director requested and obtained the sex offender registry clearance from the other state and sent a copy of the finding to the licensing inspector on April 7, 2021. The managing director completed the child abuse registry finding request form for the other state and planned to mail it on April 7, 2021. Once the results are received, a copy will be shared with the licensing inspector. The out of state background checks will be maintained in the staff record. The assigned administrative staff who hire new staff will ensure that the applicable out of state background checks are obtained as required.
