You will need to specify how the deficient practice will be or has been corrected. Just writing the word ?corrected? is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements.

Comments:
An unannounced, on-site monitoring inspection was initiated on May 23, 2024 and the inspection concluded on May 23, 2024. The on-site inspection began at 10:50 a.m. and ended at 12:15 p.m. The inspector reviewed compliance in the areas listed above. There were 9 children present and 1 staff. The inspector reviewed 5 children?s records and 5 staff records on-site. This inspection included document review, tour of the facility, interviews and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-4
Description: The center is required to obtain results of a child abuse and neglect registry search by the end of the 30th day of employment from any state in which the individual has resided in the preceding five years. Staff #4 did not have results of an out of state child abuse and neglect registry search on file.

Plan of Correction: We have updated our documentation for new employee paperwork to ensure this is completed within the expected timeline.

Standard #: 22.1-289.036-B-2
Description: The center is required to obtain results of fingerprinting by the employee's first day of employment. The fingerprinting results for Staff #3 were dated 2 months after their first day of employment.

Plan of Correction: We have updated our documentation for new employee paperwork to ensure this is completed within the expected timeline.

Standard #: 8VAC20-770-60-B
Description: The center is required to obtain a completed sworn statement prior to the employee's first day of employment. The sworn statement for Staff #3 was dated 28 days after their first day of employment.

Plan of Correction: We have updated our documentation for new employee paperwork to ensure this is completed within the expected timeline.

Standard #: 8VAC20-780-160-A
Description: REPEAT VIOLATION

The center is required to obtain documentation of a negative tuberculosis (TB) screening at the time of employment. Staff #3's TB screening was dated 20 days after their first day of employment.

Plan of Correction: We have updated our documentation for new employees to include a specific timeline to complete their TB screening prior to their hire date.

Standard #: 8VAC20-780-290-A-2
Description: Fans are required to be out of reach of children in areas used by children of preschool age or younger. There was a fan within reach of children in the Junior Kindergarten (4 to 5 year olds) classroom.

Plan of Correction: The fan has been removed from the classroom as of 5/23/24
