Technical Assistance:
Legislation effective July 1, 2020 was reviewed with an emphasis on new out-of-state background check requirements.
Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A monitoring inspection was initiated on 10/05/2020 and concluded on 10/08/2020. The director was contacted by telephone to initiate the inspection. There were 43 children present and 10 staff. The inspector emailed the director a list of items required to complete the inspection. The inspector reviewed 3 children's records and 3 staff records submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliance with applicable law and one violation was documented on the violation notice issued to the facility.
The Licensing Inspector has reviewed with the director COVID-19 Essential Guidance for Child Care Programs.
Based on record review and interview, the center failed to obtain a copy of the results of a criminal history record information check and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.
Evidence: 1. The results of a criminal record check and central registry check were not available for staff 1 from the State of Connecticut. a. Staff 1 indicated on her sworn statement or affirmation that she had resided in the State of Connecticut within the past five years. b. Staff 1 has a hire date of 09/08/2020. 2. Administrative staff confirmed that a criminal record check and central registry check from the State of Connecticut had not been obtained prior to employment of staff 1.
Plan of Correction:
All out-of-state background checks have been requested for staff 1. These were requested on October 5, 2020 and documentation of each request has been provided to the inspector. Results will be forwarded to inspection when received. Going forward, all out-of-state background checks, when applicable, will be obtained prior to employment.
