An announced monitoring inspection was made on 11/17/2020 in response to a self-reported incident on 11/11/2020. The incident involved a forbidden action toward a child from a staff person. An investigation by local social services was conducted on 11/16/2020 and by the Division of Licensing on 11/17/2020 after a briefing with local social services. Staff interviews were conducted and video recordings were observed. Based on the investigation, there was a violation cited related to this incident. The investigation was completed and the inspection report was sent to the facility representative on 12/02/2020.
Based on review of a video recording and interviews, the center failed to ensure physical punishment, striking a child, roughly handling or shaking a child, restricting movement through binding or tying, forcing a child to assume an uncomfortable position, or exercise as punishment; were actions not taken as forbidden by the Standards.
Evidence:
1. A video was reviewed of an incident on November 12, 2020. The video showed activities of children and staff in the preschool room during the afternoon of November 5, 2020, between 3:00 PM and 3:30 PM. Staff #4 was observed grabbing a preschool aged child's hair and forcefully directing the child into line behind the child's classmates. A few minutes after this incident, the same staff member pushed the same child. 2. Staff interviews with Staff #1, #2, and #3 revealed that a classmate of the child informed staff that Staff #4 pulled the child's hair. 3. Staff #1, #2, and #3 verified that Staff #4 did use forbidden actions as a means to punish a child. Staff #1 also stated that after review of the video, Staff #4 was terminated.
