22.1 BACKGROUND CHECKS CODE; CARBON MONOXIDE

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced renewal inspection was conducted on July 15, 2024 from approximately 11:00 am to 12:55 pm. Sixteen staff were present supervising eighty-one children ranging in age from infants through five years old. Additional staff were present for administrative and kitchen duties. Children were observed playing outside, eating lunch and preparing for nap time. Licensing Inspector reviewed standards related to recordkeeping, space and equipment, supervision, daily activities, special feedings, nutrition, napping, medication and emergency supplies. Eight child and eight staff records were reviewed. Violations were found and are noted on the violation notice.

Standard #: 8VAC20-780-270-A
Description: Based on observation, facility did not ensure areas and equipment of the center, inside and outside, are maintained in a clean, safe and operable condition.

Evidence: On the playground, there are two portions of the poured-in-place rubber surfacing that have collapsed leaving an opening/indention that presents a potential tripping hazard. The two areas are approximately 8" by 4" in size with a depth of 1" - 2". They are located on either side of the slide.

Description: Based on observation and review, facility did not ensure in each classroom there is a staff member that is currently CPR and first aid certified.

Evidence: Staff #7 and staff #8 were observed working together in a classroom. Record review and interview with administration confirmed neither staff are currently certified in CPR and first aid.
