Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia. A subsidy monitoring inspection was initiated on October 2, 2020 and concluded on October 9, 2020. A subsidy self-reported incident was received by the department regarding allegations in the areas of Special Services. The supervisor was contacted by email to conduct the investigation. The inspector emailed the supervisor a list of documentation required to complete the investigation. The evidence gathered during the investigation supported the self-report of non-compliance with subsidy regulations, and violations were issued. Any violations not related to the self-report but identified during the course of the investigation can be found on the violation notice.

Violations:
Standard #: 22VAC40-665-790-F
Description: Based on a review of documentation and interviews conducted by telephone, the vendor did not ensure that a child with a diagnosed food allergy shall not be served any food identfied in the written care plan.

Evidence: On October 1, 2020, an independent contractor assisting at the center gave Child #1 (four years old), who has a diagnosed food allergy, a food identified in the child's written allergy care plan. Child #1 was also wearing an allergy alert bracelet.

Plan of Correction: Youth programs and its staff aim to ensure the best care, protection and guidance for everyone involved in their programs. Immediately following the care of the child, the contractual vendor was removed from the program. Youth programs will continue to follow our policy of "no food sharing". Youth programs will also continue to make the list of known food allergies and dietary restrictions of participants known to all staff. We will also continue to wristband participants daily as an additional indicator of known allergies.
