Technical Assistance:
The licensing inspector and administration reviewed the following Standards for Licensed Child Day Centers: 22VAC40-185-340-F: Sight and sound supervision requirements for children under 10 years old 22VAC40-185-380-A-2-a-2: After 30 minutes of rest, toddlers and preschoolers not sleeping may engage in quiet activities. 22VAC40-185-400-A and B: Behavioral Guidance "In order to promote the child's physical, intellectual, emotional, and social well-being and growth staff shall interact with the child to provide needed help, comfort, and growth." "Behavioral guidance shall be constructive, age and stage appropriate, and intended to redirect children." 22VAC40-185-410: Forbidden actions include but are not limited to; enclosure in a small space, separation from the group away from the hearing and vision of staff, withholding or forcing rest, making verbal remarks which are demeaning to the child. 22VAC40-185-420-B: Staff shall promptly inform parents when persistent behavior problems are identified; such notification shall include any disciplinary steps taken in response.
Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A complaint inspection was initiated on January 6, 2021 and concluded on January 29, 2021. A complaint incident was received by the department regarding allegations in the areas of behavioral guidance, forbidden actions and supervision. The director was contacted by telephone to conduct the investigation.
The evidence gathered during the investigation did not support the allegations of non-compliance with standards or law. The licensing inspector and director reviewed guidelines for operation during the state of emergency.
