Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. The statutory requirement can be found online at https://law.lis.virginia.gov/vacode/title22.1/chapter14.1/section22.1-289.057/.

Comments:
An unannounced monitoring inspection was conducted on 05/20/2024. There were 22 children, ages 4 years - 12 years, and 2 staff members providing direct care and supervision present during the inspection. The inspector reviewed compliance in the areas of administration, staff qualifications and trainings, physical plant, staffing and supervision, programs, emergencies, and nutrition. The children were observed during arrival and self-directed activities. The inspector discussed the following with the provider: sight and sound, children?s records, and shelter in place. A total of 5 children?s records, and 2 staff records were reviewed. The inspector arrived for the inspection at approximately 6:45 am and departed at approximately 7:55 am.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.
Based on observation and record review, the center failed to ensure that the required staff to child ratio shall be maintained for 3-year-olds up to school age eligible.
Evidence: At approximately 7:50 am there were 22 children observed in care with 2 staff members. The youngest child was 4 years old. The required staff ratio for this group of children was 1:10. Three staff would be required.
Plan of Correction:
Staff will reach out to administration for additional staff on Monday mornings.
