Technical Assistance:
The provider is reminded that pursuant to Virginia Code 22.1-289.02, a family day program with 13 or more children at any location, is considered a child day center by definition.

Comments:
An unannounced monitoring inspection was conducted on 06/22/2023 to follow up on previous areas of noncompliance with the terms of the license. There were 15 children, ages 13 months-9 years, totaling 35 points, and one caregiver present upon the inspector's arrival. A second caregiver arrived during the inspection. The inspectors arrived at 12:58 pm and departed at 1:18 pm.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.

Virginia Code 22.1-289.027 states that any person that operates a child day program shall be guilty of a Class 1 misdemeanor if he operates or engages in the conduct of a child day program serving more persons than the maximum stipulated in the license. At the time of inspection, the provider was found to be exceeding the maximum capacity for a family day home as defined by the Code of Virginia.

Description: REPEAT VIOLATION

Based on observation and interview, the provider failed to ensure compliance with the terms of the current license issued by the department.

Evidence:

1. Upon arrival to the home on 6/22/2023, there were 12 children observed in the child care area of the home and 1 child observed in the small room off of the living room.

2. The door to the bedroom was observed closed and Caregiver 1 stated that her daughter was sleeping in the room. Upon further questioning, Caregiver 1 opened the door to the bedroom to reveal Child 13, determined to be 5 years old, and Child 14 determined to be 4 years old, standing together beside the bed in the dark.

3. There were a total of 15 children observed in care during the inspection. The current terms of the license issued by the department allows for a maximum capacity of 12 children.

Description: REPEAT VIOLATION

Based on observation and interview, the provider failed to ensure that the total number of children receiving care at any one time does not exceed the maximum licensed capacity of the home.

Evidence:

1. Upon arrival to the home on 6/22/2023, there were 12 children observed in the child care area of the home and 1 child observed in the small room off of the living room.

2. The door to the bedroom was observed closed and the Caregiver 1 stated that her daughter was sleeping in the room. Upon further questioning, the Caregiver 1 opened the door to the bedroom to reveal Child 13, determined to be 5 years old, and Child 14 determined to be 4 years old, standing together beside the bed in the dark.

3. There were a total of 15 children observed in care during the inspection. The maximum licensed capacity of the home is 12 children.

Description: Based on observations and interviews, the provider failed to ensure that rooms used by children in care are lighted with natural or electric lighting for the children?s safety and comfort.

Evidence:

1. Upon the inspectors? arrival to the home on 6/22/2023 at 12:58pm, two of the 15 children present in care had been sent into a bedroom with the door closed and lights off.

2. When the inspectors asked about the bedroom with the door closed, Caregiver 1 stated that her daughter was sleeping in the room. Upon further questioning, Caregiver 1 opened the door to the bedroom to reveal Child 13 (5 years old) and Child 14 (4 years old) standing together beside the bed in the dark.

Standard #: 8VAC20-800-570-A
Description: Based on observation, record review and interviews, the provider failed to ensure that a caregiver does not exceed 16 points, determined by the point system in the standards, for each caregiver.

Evidence:

1. There were 15 children, totaling 35 points, present during the inspection. A total of 3 caregivers is required for 35 points.

2. Caregiver 1 was the only caregiver present upon the inspectors' arrival to the home at 12:58 pm. Caregiver 2 was observed arriving to the home at approximately 1:13 pm
