22.1 BACKGROUND CHECKS CODE; CARBON MONOXIDE

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced monitoring inspection was conducted on May 20, 2024 from approximately 9:30 am to 11:25 am. Four staff were present supervising nineteen children ages two through six years. Children were observed eating a morning snack and doing art. Licensing Inspector reviewed standards in the areas of recordkeeping, supervision, daily activities, equipment, medication, nutrition, inspection reports and emergency supplies. Four child and four staff were reviewed. Violations found are noted on the violation notice.

Violations:
Standard #: 8VAC20-780-40-M
Description: Based on review and interview, facility did not ensure there is a current written list of all children's allergies, sensitivities and dietary restrictions kept in each room or area where children are present.

Evidence: There was not a list of children's food allergies and dietary restrictions in the classrooms. Staff #4 stated she had taken the lists from the classrooms in order to update them and had not completed it.

Plan of Correction: List of children's allergies and dietary restrictions will be updated, printed and placed in classrooms.

Standard #: 8VAC20-780-60-A-8
Description: Based on review and interview, facility did not ensure there is a written care plan for each child with a diagnosed food allergy to include instructions from a physician regarding the allergy and steps to be taken in the event of a allergic reaction.

Evidence: The record for child #4 (start date 11/13/2023) had documentation of a food allergy noted on the physical examination. There was not documentation of a allergy action plan completed by a physician. Staff #4 confirmed facility did not have the documentaiton.

Plan of Correction: Staff will inform parent again to have paperwork completed by the physician. A copy will be placed in child's record.
