Comments:
An unannounced inspection was initiated on Wednesday, February 21, 2024, and concluded on Thursday, February 22, 2024. On February 21, the inspector and the licensing administrator were on-site from 10:30am to approximately 12:50pm. The inspection focused on the review of areas of non-compliance that resulted in the issuance of a provisional license. The areas of non-compliance have been corrected and the provider has requested early compliance. Three staff records and background checks for an applicant were reviewed. Additional documentation was submitted electronically on February 22. There were no repeated violations found during the inspection.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.
Please complete the `plan of correction? and `date to be corrected' for each violation cited on the violation notice and returned it to me within five business days from today. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).
Based on a review of three staff records and interviews, the center did not obtain a required out-of-state background check from any state in which one staff member had resided in the preceding five years within the required time frame.
Evidence: The record for Staff #2, employed on 01/22/24, indicated the staff had resided in another state outside of Virginia within the last five years. The record did not contain an out-of-state search for founded complaints of child abuse or neglect. The search of the child abuse and neglect registry is required to be requested within the first 30 days of employment.
During interview, a member of management confirmed the required out-of-state background check was not obtained for Staff #2 within the required time frame.

Per the Center: "After realizing I had done the incorrect search, the correct search was done & submitted into the correct agency."

Description:
Based on a review of three staff records and interview, the center did not ensure not to accept a required criminal history record report from one staff member required to obtain background checks that was dated more than 90 days prior to the date of employment.
Evidence: The national fingerprint-based criminal record search in the record of Staff #1, employed on 01/22/24, was completed on 09/18/23.
During interview, a member of management acknowledged the background check was completed more than 90 days prior to employment.
Plan of Correction:
Per the Center: "After reviewing the licensing standards I had staff redo fingerprints to be in compliance with hire date in returning update records."
