Comments:
An unannounced non-mandated inspection was initiated, in conjunction with another agency, on 08/23/2022, and was concluded on 09/28/2022. A self-reported incident was reported to the Fairfax Licensing Office regarding an allegation involving behavioral guidance. Based on interviews conducted and review of documentation during the investigation, the evidence does support the allegation. Violations:
Standard #: 8VAC20-780-40-E
Description: Based on review of the licensee?s policies and procedures, interviews and documentation reviewed, it was determined that the licensee did not ensure that staff followed the center?s own policies and procedures required by the standards regarding behavioral guidance.
Evidence:
1. The Center?s policy on behavioral guidance states ?no physical contact (example: hitting, pushing, pulling, restraining, or sexual touching) can be permitted. All of this is considered child abuse.?
2. On 08/22/2022, Staff A separated 2 arguing children by pulling on their upper arms, leaving a visible bruise outlining two finger marks on Child A (age 2 years), which is against the Center?s own policy.

Plan of Correction: 1. All staff will receive additional training on the center's policies and procedures as required by the licensing standards by 10/17/2022. 2. Staff member A was terminated from employment on 8/23/2022.

Description: Based on interviews and documentation reviewed, behavioral guidance was not constructive in nature, age and stage appropriate, and was not intended to redirect children to appropriate behavior and resolve conflicts.
Evidence:
1. On 08/22/2022, Staff A separated 2 arguing children by pulling on their upper arms, leaving a visible bruise outlining two finger marks on Child A (age 2 years).

Plan of Correction: All staff will receive additional training on behavioral guidance that is constructive in nature, age and stage appropriate, and is intended to redirect children to appropriate behavior and resolve conflicts.
