8VAC20-790 Subsidy Program Vendor Requirements for Family Day Homes

Comments:
A subsidy health and safety (SHSI) inspection was conducted on 03/05/2024. There were 8 children present with the provider and assistant supervising. A licensing inspection was also conducted on this date. Both inspections combined cover subsidy health and safety regulations. Only subsidy requirements that are not covered in licensing standards were reviewed during this supplemental inspection.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Violations were discussed with the provider during the exit interview.

Violations:
Standard #: 8VAC20-790-180-A
Description: Based on observation, the vendor did not ensure to maintain, in a way that is accessible to all caregivers, a current written list of all children?s allergies, sensitivities, and dietary restrictions.
Evidence:
The provider/vendor confirmed that there was not a written list to show that child 3 and child 4, both currently enrolled, have food allergies and/or sensitivity or restrictions.

Standard #: 8VAC20-790-190-B-12
Description: Based on observation, the vendor did not ensure that a written care plan for each child with a diagnosed food allergy included instructions from a physician regarding the food to which the child is allergic to and the steps to be taken in the event of a suspected or confirmed allergic reaction (written care plan).
Evidence:
1. In the record provided for child 3, currently enrolled, the parent indicated a food allergy to dairy products. The record did not include a written care plan for the allergy.
2. The record provided for child 4, currently enrolled, indicated a physician diagnosed allergy to eggs. The record did not include a written care plan for the allergy.
