Comments:
An unannounced complaint inspection for the religiously exempt child day center was conducted on 10/02/2023. There were a total of 33 children, ages 2 months-4 years and 11 staff present during the inspection. Two staff members were interviewed, and video footage was reviewed. A total of 1 child?s record and 5 staff records were reviewed during the inspection. The inspector arrived at 1:30 pm and departed at 3:15 pm.

Information gathered during the inspection determined there to be violations of applicable laws. Those violations are detailed on the violation notice issued to the provider. The complaint was determined to be valid.

Description: Based on record review, the provider failed to obtain documentation that each person in a supervisory position has been certified by a practicing physician or physician assistant to be free from disability which would prevent him from caring for children under his supervision.

1. The record for Staff 1 did not contain documentation that Staff 1 has been certified by a practicing physician or physician assistant to be free from disability which would prevent him from caring for children under his supervision.
2. The record for Staff 4 did not contain documentation that Staff 4 has been certified by a practicing physician or physician assistant to be free from disability which would prevent him from caring for children under his supervision.

Based on record review, the center failed to ensure that an employee must not be employed until the agency has the person?s completed sworn statement or affirmation and to obtain the findings from a search of the central registry within 30 days of employment.

Evidence:
1. The record for Staff 1 contained a documented hire date of 08/30/2023. The sworn statement or affirmation in the record for Staff 1 was dated 09/12/2023. The sworn statement or affirmation was not obtained prior to the persons employment.
2. The record for Staff 4 contained a documented hire date of 08/23/2023. The record for Staff 4 did not contain a sworn statement or affirmation. Staff 4 was observed working during the 09/12/2023 inspection.
3. The record for Staff 1 contained a documented hire date of 08/30/2023. There were no findings from a search of the central registry for Staff 1 available for review during the 10/02/2023 inspection. Staff 1 was observed working during the inspection.
4. The record for Staff 2 contained a documented hire date of 07/11/2022. The central registry findings for Staff 2 were dated 10/25/2022; the findings were not obtained within 30 days of employment.
5. The record for Staff 3 contained a documented hire date of 09/16/2023. The central registry findings for Staff 3 were dated 10/25/2022; the findings were not obtained within 30 days of employment.
6. The record for Staff 4 contained a documented hire date of 08/23/2023. There were no findings from a search of the central registry for Staff 4 available for review during the 10/02/2023 inspection. Staff 4 was observed working during the inspection.
7. The record for Staff 5 contained a documented hire date of 06/08/2023. There were no findings from a search of the central registry for Staff 5 available for review during the 10/02/2023 inspection. Staff 5 was observed working during the inspection.
