Comments:
An unannounced code compliance inspection was initiated on 11/2/2022 and concluded on 11/2/2022 from 10:00 AM to 10:55 AM. Records were reviewed virtually. There were 49 children present, ranging in ages from 2 1/2 to 5, with 10 staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, procedures and medication. A total of three children?s records and three staff?s records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 22.1-289.031-B-5
Description: Based on a review of the staff handbook and interview, the center failed to implement a procedure to ensure that all areas of the premises accessible to children are free of obvious injury hazards.

Evidence:

1. The director stated the center policy for storage of hazardous substances is for hazardous substances to be on shelfs our of reach of children or locked in a cabinet.
2. In the second classroom, Lysol spray and disinfecting wipes were on a low open shelf. A spray bottle with a bleach and water mixture was in an unlocked cabinet.
3. In the fifth classroom, a plastic basket labeled sanitation station basket was on the counter beside the sink used by children. The basket contained Lysol spray and a spray bottle with bleach water in it.
3. The hall closet was unlocked and floor cleaner was on the floor.

Plan of Correction: Every room will be checked for hazardous substances. If any hazardous substance is not out of reach of children or locked they will be moved. All staff will be retrained in this standard.

Standard #: 22.1-289.035-A
Description: Based on record review and interview, the center failed to obtain an updated sworn statement every 5 years for a staff member.

Evidence:

The sworn statement in staff 1's record is dated 10/10/16.

Plan of Correction: Staff 1 will be required to complete an updated sworn statement. The director will review all staff records to ensure sworn statements are up to date and will create a system to ensure this requirement is followed in the future.

Standard #: 22.1-289.035-B-2
Description: Based on record review, the center failed to obtain fingerprint-based criminal history check determination letters prior to the first day of employment.

Evidence:

The hire date for staff 2 was documented as 9/1/22. The fingerprint-based criminal history check determination letter was dated 9/8/22.

Plan of Correction: In the future the director will ensure fingerprint results are received prior to staff hire.
