63.2(17) License & Registration Procedures

Technical Assistance:
Legislative changes effective July 1, 2020, with an emphasis on new out-of-state background check requirements, was reviewed.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 10/29/2020 and concluded on 11/10/2020. The director was contacted by telephone to initiate the inspection. There were 133 children present and 24 staff. The inspector emailed the director a list of items required to complete the inspection. The inspector reviewed 4 children's records and 4 staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliance with applicable law and a violation was documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the director COVID-19 Essential Guidance for Child Care Programs.

Violations:
Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review and interview, the center failed to obtain a copy of the results of a central registry check, criminal history record information check and sex offender registry check from any state in which the applicant has resided in the preceding five years. All applicants for employment and employees shall undergo a background check prior to employment.

Evidence:
1. Staff 3 lacks a criminal record check from the State of Utah. Staff 3 has a hire date of 09/08/2020 and administrative staff confirmed that a criminal record check from the State of Utah had not been requested.
2. The sex offender check, for staff 1, from the State of Florida were obtained after her employment date of 09/14/2020.
a. The results of the Florida sex offender check were obtained on 11/05/2020.
3. The sex offender check and central registry check, for staff 2, from the State of Missouri were obtained after her employment date of 09/08/2020.
a. The results of the Missouri sex offender check were obtained on 11/06/2020.
b. The results of the Missouri central registry check were obtained on 10/14/2020.
4. The sex offender check and central registry check, for staff 3, from the State of Utah were obtained after her employment date of 09/08/2020.
a. The results of the Utah sex offender check were obtained on 11/05/2020.
b. The results of the Utah central registry check were obtained on 11/06/2020.

Plan of Correction: 1. A criminal record check from the State of Utah will be requested as soon as tomorrow - but no later than November 20, 2020 for staff 3.
3. Going forward, all out-of-state background checks will be requested prior to employment.
