Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A renewal inspection was initiated on March 4, 2021 and concluded on March 5, 2021. The director was contacted by telephone to initiate the inspection. There were zero children present and zero staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed two children?s records and two staff records along with six board officer/ agent records submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility.
The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.
Based on review of the business entity page submitted 01/11/2021 and staff interview, the facility did not request the results of the out of state sex offender registry check and out of state criminal history name check required for non NFF states within the required timeframe from any state in which the applicant had resided in the past five years for board officers/agents.
Evidence:
1. Documentation indicated agent #1 had resided in another state outside of Virginia within the last five years. Agent #1 did not have a sex offender registry check from the state in which they had resided. 2. Staff #1 stated that agent #1 (hired 02/15/2018) did not have documentation of an out of state search of the sex offender registry from any other state resided in the past five years. The search was due to be completed no later than 12/31/2020 for current staff and agents and had not been completed as of 03/04/2021. 3. Documentation indicated agent #2 had resided in two additional states (state A and state B) outside of Virginia within the last five years. Agent #2 did not have a out of state sex offender registry for state A and a out of state criminal history check for state B. 4. Staff #1 stated that agent #2 (hired 03/02/2020) did not have documentation of an out of state search of the sex offender registry or a out of state criminal history check from any other state resided in the past five years. The search was due to be completed no later than 12/31/2020 for current staff and agents and had not been completed as of 03/04/2021.
Plan of Correction:
The director provided documentation to the licensing inspector dated 03/05/2021 that the out of state sex offender registry requests and the out of state criminal history check had been requested. Going forward, background checks will be completed in the allowed time frames.
