8VAC20-790 Subsidy Program Vendor Requirements for Family Day Homes

Comments:
A subsidy health and safety inspection (SHSI) was initiated and concluded on April 26, 2022. There were four children present with one caregiver supervising. A renewal inspection was also conducted on this date. Both inspections combined cover subsidy health and safety regulations. Only subsidy requirements that are not covered in the standards for voluntarily registered homes were reviewed during this supplemental inspection.


Information gathered during the inspection determined non-compliances with applicable standards or law, and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-790-190-B
Description: Based on review of two children records and interview, the vendor did not ensure one child?s record contained the required information.

Evidence:

1. The record for Child #2 (first date of attendance 07/19/2021) did not contain proof of the child?s identity;
name, address, and telephone number of at least one person designated by the parent to contact in case of an emergency if the parent cannot be reached; a written statement that the vendor will notify the parent when the child becomes ill and that the parent will arrange to have the child picked up as soon as possible if so requested by the vendor; and any written agreements between the parent and the vendor.
2. The vendor looked and could not locate these documents during the inspection.

Plan of Correction: I will have the parents complete the required paperwork and add it to the child's record.

Standard #: 8VAC20-790-230-A
Description: Based on review of two children?s record and interview, the vendor did not obtain documentation that the child has been immunized according to the requirements of State Board of Health prior to the child attending the family day home.

Evidence:
1. The record for Child #2 (first date of attendance 07/19/2022) did not contain documentation of immunization.
2. Child #2 was observed attending the family day home during the inspection.
3. The vendor stated she thought she had a copy of the immunization record but could not locate the document during the inspection.

Plan of Correction: I will ask the parents for a copy of the shot records.

Standard #: 8VAC20-790-250-F
Description: Based on documentation review and interview, the vendor did not complete the department?s health and safety update course.

Evidence:
1. The record for the vendor did not contain documentation of the department?s health and safety update course.
2. The vendor stated the updated health and safety course had not been completed as of 04/26/2022.

Plan of Correction: I will complete the required training.

Standard #: 8VAC20-790-260-A
Description: Based on observation and interview, the vendor did not maintain all equipment of the family day home in a clean, safe, and operable condition.

Evidence:

The vendor stated the diaper changing table is used for changing the children?s diapers. The base of the diaper changing table was observed to be broken and sagging underneath the diaper pad, creating a falling hazard.

Plan of Correction: I will replace the diaper changing table.

Standard #: 8VAC20-790-430-A-2
Description: Based on documentation review and interview, the vendor did not ensure shelter-in-place procedures were practiced at least twice a year.

Evidence:
1. The documentation of emergency drills did not document practice of shelter-in-place procedures.
2. The vendor stated she has not practiced shelter-in-place drills.

Plan of Correction: I will begin to practice shelter-in-place drills.

Standard #: 8VAC20-790-430-A-3
Description: Based on documentation review and interview, the vendor did not ensure lockdown procedures were practiced at least annually.

Evidence:
1. The documentation of emergency drills did not document practice of lockdown procedures.
2. The vendor stated she has not practiced lockdown drills.

Plan of Correction: I will start practicing lockdown drills.
