Comments:
This inspection was conducted by the licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
An announced monitoring inspection was conducted on 12/04/2020 in response to a self-reported incident on 11/20/2020. The incident involved forbidden actions toward a child from a staff person. Staff interviews were conducted, video recordings were observed, and the staff employment file was reviewed. Information gathered during the investigation determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility on 12/14/2020.
Based on review of video footage and interviews, the center failed to ensure physical punishment, roughly handling or shaking a child, and/or forcing a child to assume an uncomfortable position were actions not taken as forbidden by the Standards.
Evidence:
1. Video footage of incidents occurring on November 20, 2020 were reviewed by the Inspector. The video showed activities of children and staff in the preschool room during the afternoon of November 20, 2020, between 10:30 AM and 2:00 PM. In the video footage, Staff #4 was observed grabbing a four-year-old child by the arm and roughly placing the child in a sitting position. 2. During the same day, Staff #4 picked up the same child by his/her left arm for approximately a second and then the staff person used their other hand to support the child's right shoulder. Staff #4 then walked with the child to another area of the classroom to sit down with the child in the staff person's lap. After sitting down with the child, Staff #4 covered the mouth of the child for approximately two to three seconds. 3. Staff #1, #2, and #3 verified that Staff #4 did use forbidden actions as a means to punish a child. 4. Interview with Staff #1, revealed that Staff #4 was terminated for forbidden actions occurring on November 20, 2020.
