Comments:
An unannounced code compliance inspection for the religiously exempt child day center was conducted on 05/07/2024. There were a total of 78 children, ages 2 months-5 years, 12 staff providing direct care and supervision, and various support staff present during the inspection. A total of 8 children?s records and 8 staff records, as well as other required documents were reviewed during the inspection. The children were observed participating in learning activities, in free choice play and during lunch. The inspector arrived at 10:10 am and departed at 1:00 pm.

Information gathered during the inspection determined non-compliance with the Code of Virginia and violations were documented on the violation notice issued to the provider.

Violations:
Standard #: 22.1-289.031-A-4
Description: Based on record review, the provider failed to obtain documentation that each person in a supervisory position has been certified by a practicing physician or physician assistant to be free from disability which would prevent him from caring for children under his supervision.

Evidence: The record for Staff 3 did not contain documentation that Staff 3 has been certified by a practicing physician or physician assistant to be free from disability which would prevent him from caring for children under his supervision.

Plan of Correction: Staff #3 was instructed that her certificate had to be completed. Staff #3 will be taken off schedule until completed.

Standard #: 22.1-289.031-A-5-d
Description: Based on observation and staff interviews, the center failed to ensure that any child, up to age eight, whom is being transported in provided with and properly secured in a child restraint device of a type which meets the standards adopted by the US Department of Transportation.

Evidence: Review of the vehicles used to transport children daily to and from school determined that there were no child restraint devices available for use by children under the age of 8 years as required by the Code of Virginia. Staff 8 verified that there were no child restraints available. The staff verified that there were a total of 16 children under the age of 8 years that are transported daily.

Plan of Correction: Parents of children under the age of 8 have been instructed that a booster seat is to be provided.

Standard #: 22.1-289.031-A-9
Description: Based on observations, the center failed to be in compliance with all safe sleep guidelines recommended by the American Academy of Pediatrics.

Evidence: Child 8 (2 months old) was observed sleeping in a crib that contained a blanket and a Boppy Pillow. The American Academy of Pediatrics recommends keeping loose blankets, pillows, stuffed toys, bumpers and other soft items out of the sleep space.

Plan of Correction: Blankets and boppy pillows have been removed from cribs. Staff received training in this area.

Standard #: 22.1-289.036-B-2
Description: Based on record review and observations, the vendor failed to ensure that no person shall be hired for compensated employment prior to the facility obtaining an employment eligibility letter upon the completion of a fingerprint background check as required by the Code of Virginia.

Evidence: The record for Staff 1 contained a documented hire date of 02/12/2024; there was not an employment eligibility letter available for Staff 1. Staff 9 verified there was not an employment eligibility letter for Staff 1.

Plan of Correction: Staff #1 has completed the background check.

Standard #: 22.1-289.049-A
Description: Based on record review, the center failed to ensure that upon enrollment of a child in a regulated child day program, the center shall require that the person enrolling the child presents the program with the proof of the child?s identity and age.

Evidence:
1. The record for Child 6 did not contain documentation of identity or age.
2. The record for Child 8 did not contain documentation of identity or age.

Plan of Correction: Parents were notified of any missing documentation and given until 5/28/2024 to correct.
