Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 8/26/2021 and concluded on 9/07/2021. A self-reported incident was received by the department regarding allegations in the areas of diapering. The director was contacted by telephone to conduct the investigation. The inspector emailed the director a list of documentation required to complete the investigation, video footage was reviewed and interviews were conducted.

The evidence gathered during the investigation supported the self-report of non-compliance with standards or law and violations were issued. Any violations not related to the self-report, but identified during the course of the investigation can be found on the violation notice.

Violations:
Standard #: 22VAC40-185-180-B
Description: Based on the interview, a staff member was not capable of communicating effectively orally as applicable to the job responsibility.
Evidence:
1. Staff #1 was interviewed on 8/26/2021 and was not able to communicate orally as applicable to the job responsibility. Staff #1 did not speak or understand English during the interview.

Plan of Correction: Teacher has been paired with English speaking teacher.

Standard #: 22VAC40-185-500-B
Description: Based on review of the center?s video footage, staff interviews and review of documentation, a staff member at the center did not clean and change a child immediately when the child's diaper became wet.
Evidence:
1. On 7/29/2021, Child #1 was not cleaned and changed immediately after their diaper became wet at approximately 10:40am.
2. The diaper report for Child #1 documented that Child #1 was wet at approximately 10:40am. Staff #1 confirmed that she did not change the child?s diaper and the information entered on the diaper report was incorrect. Child#1 had a diaper change at approximately 8:35am and was not changed a second time until approximately 12:34pm.
3. Staff #1 stated "I did not change Child #1 diaper. I was too busy, there was a lot going on. I did not change her diaper. Her diaper was wet. I was going to change her, but there were some new children crying. I forgot."
4. The center?s video footage confirmed that Staff #1 did not change Child #1?s diaper at approximately 10:40am as indicated in the child?s daily report.

Plan of Correction: We have retrain our staff on how to documented using the daily form of communication. All infant staff have been retrain on the diaper changing policy.
