Comments:
The licensing inspector conducted an unannounced complaint inspection on July 10, 2019 in response to complaints that were received by the Department on June 26, 2019 and July 2, 2019 concerning staffing and supervision. The inspector was on site on July 10, 2019 from 2:35pm to approximately 4:28pm. Interviews with staff were completed, documentation was reviewed, and observations were made at the center. Additional documentation was reviewed on July 11, 2019. The preponderance of the evidence gathered during the investigation does not support the allegation, therefore, the complaint was determined to be not valid. However, an unrelated violation was found and is identified on the Violation Notice.

Please complete the `plan of correction? and `date to be corrected? for each violation cited on the Violation Notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).

Description: Based on a review of documentation and interviews, the center did not ensure that when staff were supervising children, they shall always ensure their care and protection.

Evidence: 1) During interviews on 07/10/2019, staff reported that during classroom observations through the center's video monitoring system, Staff #1 and Staff #2, who were supervising the preschool children, were observed taking children's unopened leftover snacks and placing them in their personal bags.

2) Documentation reviewed on 07/10/2019 showed that a snack that was labeled with Child #1's name was inside of Staff #1's bag. It was reported that Staff #1 and Staff #2 were terminated on 06/21/2019 as a result of this incident.

3) Additional information was provided to the licensing inspector by a collateral party on 07/11/2019. The statement reviewed stated that during the time in which Child #2 was under the care of Staff #2, none of the items packed in Child #2's lunch box were returned home. The statement reports that after Staff #2 left the center, during the week of 06/24/2019, several unopened and uneaten items were returned in Child #2's lunch box.

Plan of Correction: Per the Center: "1. The day we observed the two teachers stealing children's prepackaged food we immediately fired them.
2. A new policy was implemented and all employees had to read and sign stating that employees may not eat or take home any part of a child's breakfast, lunch or afternoon snack. This policy is now part of orientation.
3. Lead teachers in the room will monitor the children's food during meal and snack times. They will make sure new employees understand the policy concerning food brought in by parents for their children's consumption only. The office will also monitor the meal times to ensure no child's left over food is placed anywhere except their lunchbox."
