An unannounced complaint investigation was initiated on August 16, 2019 in response to allegations regarding transportation, background checks, and ratio. Based on staff interviews and documentation reviewed, the preponderance of evidence gathered during the investigation supports the allegation regarding background checks and transportation. Based on staff interviews, review of documentation, and observation of the vehicles, the facility failed to ensure that the stated maximum number of passengers in a given vehicle shall not be exceeded. Evidence: 1. On June 27, 2019, 40 children went on a field trip to Maymont Nature Center on three center vehicles (15 passenger, 15 passenger, and 22 passenger). One of the 15 passenger buses broke down at Maymont. All of the children and six staff were transported back to the center in two vehicles, a 15 passenger and 22 passenger. Several children and teachers were sitting three to a seat, sitting on the bus floor, or standing in the bus aisle due to lack of space to be seated. 2. On July 2, 2019, children were taken on a field trip to the ARC park on two center vehicles again, where not all children and staff had seats.

Based on review of five staff files, the facility failed to have obtained fingerprint results for all staff prior to employment. Evidence: Staff 4 was hired 7/15/2019, but the fingerprint results were not received by the center until 7/18/2019.
