Comments:
A code compliance inspection was initiated on Thursday, May 18, 2023 and concluded on Friday, May 19, 2023. On May 18, the inspector was on site from 9:25am to approximately 11:40am. There were 116 children in attendance with 24 staff directly supervising. During the inspection, the children and staff were observed participating in a variety of activities. Staff were observed having positive interactions with the children. The center is equipped with toys and supplies and items were available to the children. All areas of the facility including classrooms, hallways, the outdoor play area, and bathrooms were inspected. Ten children's records and ten staff records were reviewed. Additional documentation was submitted electronically on May 19, 2023.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.
Based on a review of ten staff records and interview, the center did not ensure five staff had the satisfactory results of the fingerprint-based national criminal background check prior to employment and within the required timeframe.
Evidence: 1) The fingerprint-based national criminal background check in the record of Staff #3, employed on 09/08/20, was completed on 05/19/20. The facility must not accept a required background check that is dated more than 90 days prior to employment.
2) The fingerprint-based national criminal background check in the record of Staff #5, employed on 09/08/20, was completed on 05/22/20. The facility must not accept a required background check that is dated more than 90 days prior to employment.
3) The fingerprint-based national criminal background check in the record of Staff #6, employed on 08/29/22, was completed on 03/02/22. The facility must not accept a required background check that is dated more than 90 days prior to employment.
4) The fingerprint-based national criminal background check in the record of Staff #7, employed on 09/13/21, was completed on 03/09/21. The facility must not accept a required background check that is dated more than 90 days prior to employment.
5) The fingerprint-based national criminal background check in the record of Staff #9, employed on 11/01/19, was completed on 11/08/19.
6) During interview, a member of management confirmed the fingerprints were not obtained within the required timeframe.
Plan of Correction:
In the future, background checks will be completed prior to employment and will not be accepted if they are dated more than 90 days prior to employment.

A complete sworn statement or affirmation is required before employment. A search of the central registry check is required within 30 days of employment. The facility must not accept a required background check that is dated more than 90 days prior to employment.
Plan of Correction:
Staff will complete the sworn statement prior to employment. In the future, background checks will not be accepted if they are dated more than 90 days prior to employment.
