Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia. A monitoring inspection was initiated on October 23, 2020 and concluded that afternoon. The Provider was contacted by telephone to initiate the inspection but was unable to communicate effectively to answer questions and assistant was not available. There were 6 children present and 1 staff and that time for a total of 17 points. In the afternoon, the assistant was available and there were only 5 children remaining. The Inspector emailed the Provider a list of items required before the inspection and after to complete the inspection. The Inspector reviewed children?s records and staff records submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the facility or the program.

Violations:
Standard #: 22VAC40-111-130
Description: Based on interview and discussion, it was determined the provider was unable to demonstrate the qualification that she was able to speak in English as necessary to carry out job responsibility.
Evidence:
1. On the morning of October October 23, the Inspector called and the Provider was not able to answer questions. She said she needed her assistant to talk but she was not available.
2. Inspector attempted to talk with Provider but she was unable to answer the questions. Inspector called back in the afternoon to talk with provider and assistant and through assistant, she stated she knows she needs to improve on her English.

Plan of Correction: Inspector stated provider needs to enroll in an ESL class and improve language skills

Standard #: 22VAC40-111-570-A
Description: Based on interview and review of records, it was determined the Provider did not ensure that a caregiver does not exceed 16 points at any time.
Evidence:
1. Inspector called around 11 am and Provider stated she was alone with the children because assistant was in class. Provider after being asked several times was able to confirm she had 6 children in care.
2. Inspector later that day requested that the assistant send her the list of children enrolled (including birthdates) and attendance. Review of attendance and child information revealed the Provider had 17 points at the time she was alone.
3. The assistant explained she was attending an online hour long class that takes and caregivers then acknowledged that assistant was not present where children were receiving care.

Plan of Correction: The assistant resides in the home and has only one live class and we will find another caregiver for back up so not to be over points again.
