Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program. A monitoring inspection was initiated in response to a self report made on 08/02/2021. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22VAC40-185-180-B
Description: Based on interviews and record review the center did not ensure staff were capable of their assigned responsibilities.

Evidence:
On 07/30/21, Staff A did not demonstrate she was capable of carrying out her assigned responsibilities.

1. When the lead teacher, Staff C in the 12-16 month room went home early on 07/30/21, the teacher assistant, Staff A, was left alone supervising 4 children from around 12:30pm until approximately 12:39pm, and from 1:42pm until Staff B was called to change diapers for Staff A around 2:50pm.

2. In an interview, Staff A stated "I can't pick-up kids because I'm pregnant and I have a doctor?s note." Staff A stated when she needs to lift a child or change a diaper, she calls another staff in the room to do it for her.

3. Staff B, C and a member of management, Staff D, confirmed they were aware that Staff A could not pick-up children. Staff D confirmed she was aware staff A was alone in the classroom that day with the 4 children.

4. When asked how she would get the 4 children she was caring for out of the building during an emergency, Staff A replied, "I don't know."

Plan of Correction: The following corrective action was provided by the licensee:
"Medical documentation of the Staff A not being capable of carrying out her responsibilities was not provided to the school."

Standard #: 22VAC40-185-220
Description: Based on interviews and record review, the center did not ensure aides were at least 16 years of age.

Evidence:
On 07/30/2021 a staff member's 8 year-old child performed the duties of an aide, which is defined in the standards as ?an individual designated to be responsible for helping the program leader in supervising children and in implementing the activities and services for children.?

1. On 07/30/21 Staff B brought her 8 year-old child to work with her. Staff B stated this had been her 2nd full day as a ?helper,? and confirmed she was not always supervising her.

2. Three staff members confirmed observing the 8 year-old engaging in the following activities with the children in the 12-16 month-old room: feeding children, picking children up, holding them under the arms while walking them, cleaning tables and reading to them.

3. Staff A, who was physically unable to pick-up children, reported she and the 8 year-old child were the only ones present in the classroom with 4 toddlers in care.

Plan of Correction: The following corrective action was provided by the licensee:
"Staff children are no longer allowed in the classroom."
