Technical Assistance:
Discussion on actively supervising children at all times during outdoor play.

Discussion on removing large rocks and planters to prevent a child from climbing on the items

Discussion of installing two way locking system for the gates entrance. No children were on playground at the time of this observation.

Comments:
An unannounced monitoring inspection was conducted today from approximately 9:15 am and 11:00 am. There were 6 children (14 points) in care of the provider. A walk-through of the entire home was completed.

3 children?s and 1 staff record, 3 household records, caregiver training, children?s nutrition, supplies, emergency procedures and drills were inspected. The children were observed playing with toys on the floor, group activities and eating a snack. Areas of non-compliance are identified in the Violation Notice.

Violations:
Standard #: 22VAC40-111-240-A
Description: Based on observation, areas of the family day home, inside and outside, were not maintained in safe and operable condition.
Evidence:
1. The wire fence in the backyard area has protruding wiring that could entangle or snag skin.
2. The gate entrance located outside (two on the side of the home and one in near the lake) the latches were not properly secured to prevent children having the ability to unlock the gate.
3. Te provider stated the children do not have access to the outside play area because additional repairs were needed to the backyard area.

Plan of Correction: Please note that currently children don?t have any access to the outdoor play area of the home.
We fully accept these recommendations.
Fencing has been thoroughly inspected for any protruding and resolved them in a couple of spots to make sure there is no impact to children in case of outside play in the backyard.

For all three gates, we installed latches secured by lock/key more than 4 feet above so that it is completely child proofed.

Standard #: 22VAC40-111-430-B
Description: Based on observation, accordion expansion gates were used as a protective barrier at stair openings.
Evidence:
1.The bottom of the steps leading to the second floor inside the home were blocked with an accordion gate.
2. The gate was not mounted and had diamond shaped openings between the slats.
3. Children under two years of age were in care during the inspection.

Plan of Correction: Accordion safety gate in use during inspection has been secured on both sides of the staircase to prevent any children access.
Following through based on inspector?s recommendation, it?s been replaced by a safety gate with no diamond shaped openings and locked in place.

Standard #: 22VAC40-111-440-A
Description: Based on observation, there was not a protective barrier preventing access to the deck.
Evidence -
1. On the date of inspection (10/24/2019), a protective barrier was not installed at the bottom of the deck steps to prevent children from having access to stairs with three or more risers.
2. Without gates in this area, children using the backyard play area would have access to the deck, and to the hot tub located on one of the raised platforms.

Plan of Correction: Based on previous inspection, we realized it was only upstairs gate as children aren?t currently accessing any areas downstairs. We have reviewed the recommendation and now installed gate with self-locking mechanism downstairs as well preventing access to the deck.
With both the gates, and as an additional measure, also hot tub access being locked ? there?s no access to the tub.
