Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious-exempt child day centers that serve preschool-age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
an unannounced non-mandated inspection for classroom measurements was conducted on 07/11/2024 from 11:00 am to 11:53 am. During the inspection, an incident of supervision was investigated, and information gathered during the investigation determined non-compliance and violations were documented on the violation notice issued to the program. Thank you for your cooperation during this inspection. Please submit your plan of correction within 5 business days for it to be included on the website.

Violations:
Standard #: 8VAC20-780-340-A
Description: Based on observation and staff interviews, the center failed to ensure care, protection, and guidance while supervising children.

Evidence:
1. On Thursday, July 11, 2024, at approximately 11:14 am, Child #1 (2 years old) was found sitting alone and unsupervised on the floor in Classroom #9.
2. Staff #2 stated they completed a head count in the hallway to ensure all seven students were present before entering the classroom at approximately 11:05 am. However, they failed to perform a second head count once inside, resulting in their unawareness of Child #1.
3. At approximately 11:12 am, Staff #2 noticed that Child #1 was not in the room and called another staff member to help in locating Child #1.
4. Staff #2 stated that they suspected Child #1 slipped out of line and walked to Classroom #9 while they were waiting in the hallway.
5. Child #1 was alone and unsupervised in Classroom #9 for approximately nine minutes.

Plan of Correction: The school director has already talked with Staff # 2 and has re-trained staff # 2 in policies and procedures regarding attending children all the time at school and playground safety procedures. The school director will also routinely monitor and continue to train Staff # 2 and all other staff for the compliance with policies about attending children all times. The school director to re-enforce this in the next staff meeting.

Description: REPEAT VIOLATION

Based on observation and staff interviews, the center failed to ensure that all children under 10 years of age were always within actual sight and sound supervision of staff.

1. On Thursday, July 11, 2024, at approximately 11:14 am, Child #1 (2 years old) was found sitting alone and unsupervised on the floor in Classroom #9.
