Comments:
A complaint inspection was conducted on March 10, 2023, in response to a complaint that was received by the department on February 27, 2023, regarding allegations in the care of the children at the center. Staff were interviewed, documentation was reviewed, classroom observations were completed, and a tour of the area facility was conducted. Information gathered during the inspection determined non-compliance with applicable standards or law and a violation was documented on the violation notice issued to the program. The violation was discussed at the exit interview with the program director of the school and the quality control manager.
Based on interviews and written statements, it was determined that the center did not ensure that the following actions or threats thereof are forbidden: forcing a child to assume an uncomfortable position as punishment. Evidence: 1. Staff #3 observed Staff #2 holding Child #1 by their ankles in a vertical position upside down. The child?s head was over 12 inches off the ground. Staff #3 heard Staff #2 state to Child #1, ?Child #1 it?s time to go to sleep!? 2. Staff #4 observed Staff #2 holding Child #1 upside down by her feet stating, ?Ha ha, I scared you.? Child #1 was observed vertical and off the ground being held by their feet. 3. Staff #1 completed an internal investigation and interviews were conducted of staff that observed the incident. Staff #1 confirmed that they had enough to support the allegations in which the child was placed upside down by Staff #2. Administrative action was taken on Staff #2 which resulted in termination.
Plan of Correction:
Plan of correction: The center conducted an internal investigation with regards to this matter and the staff member in question was terminated. All staff members at the facility completed a refresher training course and signed off they are aware of licensing standards and policies of the center regarding matters such as this. Staff will continue to have coaching staff in the building for observations regarding staff and children?s interactions. Staff has ensured that they continue monthly trainings to enrich staff?s understanding of licensing standards and code.
