Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews, and a review of the playground.
A self reported incident was received on 4/13/2021 regarding supervision on the playground.
The inspection was initiated on 4/13/2021 and concluded on 9/28/2021. Additional information was obtained 6/3/2021, 7/27/2021 and 9/28/2021. The director was contacted by telephone to conduct the investigation. The inspector emailed the director a list of documentation required to complete the investigation.
The evidence gathered during the investigation confirmed non-compliance with standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22VAC40-185-40-E
Description: Based on interviews with staff and review of the center's supervision procedures and playground safety procedures, the facility failed to follow the center's own policies and procedures that are required by these standards. Evidence: the center's Interactions with Children policy states, "Supervise children at all times" and the Playground Safety policy states, "The Center's staff shall ensure supervision of children on all playgrounds to provide a safe outdoor play environment." On April 7, 2021, Child 1 (age 2 years) crawled through a hole in the fence and was out of supervision of the staff present for an undetermined length of time. There were two staff present on the playground at the time of the incident.

Plan of Correction: All staff receive training upon hire, but we will do additional training for new staff members coming on. Two staff members that were present were terminated.

Standard #: 22VAC40-185-270-A
Description: Based on staff interviews and review of the outside play area, the facility failed to maintain all areas and equipment of the center in a safe condition. Evidence: the fence was broken at the ground level where a panel measuring 12 x 12 inches was missing. On April 7, 2021, Child 1 (age 2 years) was able to crawl through the hole in the fence of the playground.

Plan of Correction: Landlord fixed the hole in the fence immediately.

Standard #: 22VAC40-185-340-A
Description: Based on interviews and a review of documentation, the facility failed to ensure that when staff are supervising children, they always ensure their care, protection, and guidance. Evidence: 1. On April 7, 2021, Child 1 (age 2 years) crawled through a hole in the fence of the playground. 2. A passerby saw the child on Finlay Street outside the fence of the playground. The passerby stopped and handed the child over the fence to the staff, who reportedly could not unlatch the gate. 3. Staff reported to the director that they "had retrieved the child before the child went through the hole completely". 4. On April 9, 2021, the owner received a phone call from the passerby's husband, who reported that his wife had retrieved the child and handed the child over the fence to the staff. 5. Finlay Street is a two lane road and the speed limit is 25 mph.

Description: Based on interviews and review of documentation, the facility failed to have all children under the age of ten in actual sight and sound supervision. Evidence: 1. On April 7, 2021, Child 1 (age 2 years) crawled through a hole in the fence of the playground. 2. A passerby saw the child on Finlay Street outside the fence of the playground and was out of sight and sound supervision of the staff for an undetermined length of time.. The passerby stopped the car, retrieved the child, and handed the child over the fence to the staff, who reportedly could not open the gate. 3. Finlay Street is a two lane road with a speed limit of 25 mph.
