Comments:
The local agency representatives and licensing inspector conducted an unannounced complaint inspection on 02/11/2020 between 2:00 pm to 3:00 pm in response to a complaint that was received by licensing on 02/03/2020 related to allegations in the area of programs and staffing and supervision of the standards. During the inspection, the licensing staff conducted interviews with staff, completed observations at the center, reviewed staff and children records, and other pertinent documentation and evidence. The preponderance of the evidence gathered during the investigation was determined to be valid for the supervision of children and not valid for programs as it relates to the licensing standards. Description: Based on interviews, documentation, video footage, and photographs, the center did not ensure to always ensure care, protection, and guidance when supervising children.

Evidence:
1. Interview with Staff#1 confirmed the incident on 02/03/2020 involving Child#1, age 4 sustaining a burn on the right upper thigh at the center due to a hot cup of soup spilling on the child?s leg. Staff#1 stated she prepared the cup of soup in the center kitchen microwave oven then allowed the soup to sit on the table first in the classroom for approximately 7-8 minutes. Staff#1 reported she proceeded to gather the children's lunches to place on the table in the classroom and the children started coming in with Staff#2. Staff#1 revealed the hot cup of soup was located on the table accessible to the children at the table prior to her pushing it aside to do what she needed to do to it. Staff #1 stated she then placed a banana next to Child#1's bowl. Staff #1 stated she heard Staff #2 tell Child#1 "not yet the soup is still hot." Child#1 reached for the banana and tipped over the plastic soup bowl spilling the soup on the table and Child#1's leg. Staff#1 stated Child#1 started screaming and she could not see the effects initially because child had on black pants.

2. Interview with Staff#2 confirmed being present in the classroom on 02/03/2020 and knowledge of Child#1 sustaining injury on his leg.

3. A review of center's video footage revealed six children sitting at the table. Child#1 was observed sitting with the cup of soup on the table directly in front of him. Two staff members, #1 and #2, were observed on the video recording. Child#1 was observed talking, making hand gestures, and pointing at the soup as Staff #2 was facing the child. After the spill, Child#1 was observed jumping up and down, crying, and holding onto his pants.

4. Written documentation, the center?s serious injury report confirmed the incident as described on 2/03/2020 involving Child#1.

5. A review of medical summary dated 2/03/2020 confirmed the diagnosis of thermal burn to the leg thigh area of Child#1.

6. Photographs taken of Child#1 injuries on 02/03/2020.

Plan of Correction: There will be no hot liquids served to the children. The staff will be more mindful of what is being served.
