A complaint inspection was conducted on 5/03/2023 following a complaint received 4/20/2023 regarding the licensed capacity.
The inspector interviewed caregivers and reviewed attendance sign in and out sheets. The evidence gathered during the investigation supports the allegation of non-compliance with standards or law. The complaint is determined to be valid.

Based on review of attendance records and provider interview, the provider failed to ensure that the total number of children receiving care at any one time does not exceed the maximum licensed capacity of the home. Evidence: The licensed capacity of the home is 12. The provider was over capacity on the following dates and times: On March 13, 2023, the attendance record shows the provider had 15 children between 8:15 a.m. and 8:30 a.m. and had 13 children between 4:45 p.m. and 5:00 p.m. On March 14, 2023, the attendance record shows the provider had 18 children in care between 8:15 a.m. and 8:30 a.m. On March 15, 2023, the attendance record shows the provider had 16 children in care between 8:15 a.m. and 8:30 a.m. and 15 children between 4:45 p.m. and 5:00 p.m. On March 17, 2023, the attendance record shows the provider had 15 children in care between 8:15 a.m. and 8:30 a.m. and 16 children between 4:45 p.m. and 5:00 p.m. On April 19, 2023, the attendance record shows the provider had 14 children in care between 8:15 a.m. and 8:30 a.m. and 15 children between 4:45 p.m. and 5:00 p.m. The caregiver acknowledged that there were more than 12 children present at times.
