An unannounced complaint investigation was conducted on September 1, 2023 in response to a an allegation regarding serious injury reporting. Interviews with staff were conducted, observations were made in the home, and documentation was reviewed. The preponderance of the evidence gathered during the investigation does not support the allegation; therefore, the complaint is determined to be not valid. A violation not related to the original complaint was cited.

REPEAT VIOLATION Based on observation and interview, it was determined that the provider failed to ensure that the total number of children receiving care at any one time did not exceed the maximum licensed capacity of the home. Evidence: The family day home has a licensed capacity of 12 day care children. On 9/1/2023, at 1:00 p.m. the licensing inspector observed 13 daycare children present. Caregiver 2 acknowledged that there were 13 children present on 9/1/2023.
Plan of Correction:
Caregiver 2 stated that school was out today and they miscounted the number of children in attendance.

Based on review of documentation and observation, the provider failed to keep an accurate written record of attendance each day. Evidence: at approximately 1:00 p.m. on 9/1/2023, nine children were marked as present on the attendance record. Thirteen children were present.

Description:
Based on observation and record review, the provider failed to have substitute providers record and sign the time of arrival and departure on each day that the substitute provider works. A substitute provider is when the provider is absent from the home for more than two hours. Evidence: there was no documentation of a substitute provider time sheet on 9/1/2023. The provider was out of town on 9/1/2023 and a substitute provider was present.
Plan of Correction:
Substitute providers will document times present on the timesheet.
