Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia. A monitor inspection was initiated on June 14, 2021 and concluded on June 23, 2021. The program director was contacted by telephone to initiate the virtual, remote inspection. There were 59 children present with five13 staff. Children present ranged in age from seven months to nine years old. The inspector reviewed a list of items required to complete the inspection. The inspector reviewed three children?s and three staff records during the virtual, remote inspection to ensure documentation was complete. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility. The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs
Based on record review and interview the center failed to ensure that out of state background checks are obtained within the allotted time frame. Evidence: 1 - The record for staff 3 does not contain and out of state sex offenders background as required. a. The Sworn Statement or Affirmation for staff 3 states that she lived in another state in the past five years b. Staff 3 has a documented date of hire as April 19, 2021. 2 - Staff 1 and 2 confirmed that there was not an out of state sex offenders background completed for staff 3.
Plan of Correction:
Hiring Managers have been trained on the new 2020 Legislative Implementation. Managers now understand the difference between the out of state criminal background search that was completed on staff 3 versus the out of state sex offender background check that is now required.
Hiring Managers were also instructed that even though a Virginia Sex Offender search was completed on staff 3, that an out of state Sex Offender search is still required for individuals who live outside the state within the past 5 years.
An out of state sex offender background check was requested from the agency for staff 3.
