Comments:
An investigation was conducted in response to a self-reported incident received by our office regarding care and protection of an infant. Based upon multiple interviews, the preponderance of evidence does support a violation.
A monitoring inspection was also completed during the investigation to determine compliance in areas of staff to child ratios, a sample of staff and child records were reviewed, as well emergency planning procedures, supplies and drills.

This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to the state of emergency health pandemic declared by the Governor of Virginia.
Based on video recordings mandeon 9/23/2021 and staff interviews, it was determined that behavior guidance used by staff #1 with a child in care was not constructive in nature, age and stage appropriate and did not re-directchildren to appropriate behavior.
Evidence: On 9/23/2021 Child A was observed playing on their tummy and moving towards a gate to the other side of the classroom. Staff #1 who is seated behind the child pulls child back towards them by the arm to prevent forward motion toward the gate. Based on interviews, Staff #1 confirmed that the tone used to speak with the children was "short" and not constructive and caring in natture.

Description:
Based upon observation, areas and/ or equipment were not used in a safe way for the age of the children uttlizing.
Evidence: 4 infants in the Butterflies classroom were observed in low to the floor high chairs with removable trays. While cleaning up from snack and sweeping the floor, they trays were removed from the chairs and the children can be seen rocking back and forth potentially throwing the balance of the chairs off.
