Technical Assistance:
During follow up inspections Inspector discussed the class room management, staff training and facility policy and procedures.

Comments:
An investigation was initiated on 10/8/2019 in response to a self-reported incident received by our office regarding the behavioral guidance and forbidden actions against a child in care. A monitoring inspection was also conducted on the day the investigation was initiated. Child files, center practices, staff files and emergency supplies were reviewed. Based upon multiple interviews and review of center operation documentation, the evidence does support a violation, as indicated on the violation notice.

Violations:
Standard #: 22VAC40-185-40-E
Description: Based on multiple interviews and review of documentation it was determined that the operational responsibilities of the licensee shall include, but not limited to, ensuring that the center?s own policies and procedures that are required by these standards were not followed.
Evidence:
1. On page 28, of the Employee Handbook for Tots and Us it states: ?Center staff is to: use praise and positive reinforcement to prevent misbehavior?. However, Staff A, C and E reported that children may be consistently placed in time out and sometimes held to calm down.
2. On page 29, of the Employee Handbook for Tots and us it states ?structured consequence that follow specific misbehaviors and the child should be able to see how behaviors and consequences are related.? However, when staff B and C were asked what the policy for redirection was, they stated that they did not know.

Standard #: 22VAC40-185-400-A
Description: Based on multiple interviews with staff it was determined that staff did not interact with children in order to promote the child?s intellectual, emotional and social well- being as well as provide needed help, comfort , support, encourage independence, self-direction and use consistency in applying expectations.
Evidence:
1. During interviews and conversations conducted on 10/4/2019, 10/8/2019 and 10/23/2019 Center staff were unable to articulate a consistent procedure for redirecting behavior. Staff stated that sometimes children are put in time out. Other times children are held until they calm down. Staff could not articulate age and stage appropriate and consistent practices for ?time- out? procedures.
2. Staff A stated that while Child A was being reprimanded for behavior the child was laughing and running around the room and staff A ?held them still ?so that the child A understood staff A was serious.
