22.1 Early Childhood Care and Education

Comments:
An inspection in response to a self-reported incident was initiated on November 1, 2023 and concluded on January 26, 2024. The investigation was conducted jointly with local agencies. The report received by the department included information of a staff member using inappropriate behavioral guidance techniques and forbidden action.

The Centers video recordings were observed, staff interviews were conducted, and the center?s staff records and children records were reviewed in response to the self-reported incident.

The evidence gathered during the investigation supported the self-report of non-compliance with standards or law, and violations were issued. Any violations not related to the self-report but identified during the course of the investigation can also be found on the violation notice.

Violations:
Standard #: 8VAC20-790-550-5
Description: REPEAT

Based on record review and staff interview, the vendor did not ensure documentation of orientation has been completed, including the date completed, the total hours of session, and the names of the trainer and of any sponsoring organization.

Evidence:
On November 1, 2023, the vendor was unable to provide orientation training documentation for Staff #1 that contain specific topics.

Confirmed with Staff #2 the documentation with all required information was unable to be located.

Plan of Correction: New Director transition into this position in June and was unaware of the lack of documentation for staff that were hired prior to Director start date.

New director revised the orientation training for staff. Created excel sheet to keep track of the trainingnthat the staff completes.

New director has reached out to Licensing for Subsidy requirement training/consultation, Infant toddler network and Child Care Aware
in the past few months.

More training will be given to staff through multiple online service that are provided by VDOE.

Standard #: 8VAC20-790-700-A
Description: Based on video footage and staff interview, the center did not ensure that behavioral guidance shall be constructive in nature and age and stage appropriate and shall be intended to redirect children to appropriate behavior and resolve conflicts.

Evidence: On multiple days, with various children, Staff #1 was observed on video footage using behavioral guidance that not constructive in nature, age and stage appropriate and not intended to redirect the children to appropriate behavior.

1. On October 2, 2023 in the toddler room, Child #1( 15 months ) was touching and moving a baby activity station. Staff #1 moved child #1 with her foot when he was sitting on the floor pushing him away from the baby activity station.

2. On October 3, 2023 in the toddler room, Child #2 (20 months) is moving on his mat and
staff #1 lifted child #2 by their ankle and wrist. Staff #1 pulled the child up and put him on his
stomach.

3. On October 23, 2023 in the toddler room, Children were not staying on the mats at rest time. Staff #1 was observed pulling and lifting children by their arms , legs, ankles, thighs, and back of their pants to move them on the mat. Staff #2 was also pulling children by wrist and legs.

4. On October 30, 2023, in the toddler room, children were observed moving on the mats. Staff #1 lifts a child by the back of their pants, picks children up by legs and arms off the mat, lift up by ankles and kicks a child.

Plan of Correction: Staff #1 was immediatley released on October 30, 2023 after reviewing camera footage from October 30, 2023. And the center conducted further investigation.

Classroom video footage is being reviewed often by the Director to make sure the center is in compliance,the children are safe and determined additional training needed for staff.


Staff have been given guidance that children are not required to fall a sleep during nap time/rest time but they can sit on there rest mats quitley. The Director has recommended for staff to have a quiet box so they have things to do during the naptime/rest time.

There will be a Professional Development Day on February 23, 2024 to review over requirements.

The center will review the proper way of moving children. Children will not be moved by a person foot. The center will address that staff's feet should not be used on any child.

Standard #: 8VAC20-790-710-1
Description: Based on video footage, review of documentation and staff interview, the vendor did not ensure the following actions or threats thereof are forbidden physical punishment , including striking and roughly handling a child.

1- On October 2, 2023 in the infant room at 11:37am, child#1 (15 months) is observed sitting on the floor and staff #1 used her foot to push child #1 away from the infant activity station .

2- On October 3, 2023 in the Toddler room at 12:06pm, staff#1 lifts child # 2(20 months) by the left ankle and left wrist off the nap mat and swings him over on his stomach onto the nap mat.

3- On October 23, 2023, in the toddler room at 11:38am, staff#1 grabs child #4 (20 months) pants and shirt and pulls the child causing the mat to move. Staff #1 then picks child#4 up off the mat by right bicep and right thigh. Staff #1 puts child #4 roughly on the rest mat.

4- On October 23, 2023, in the toddler room at 11:39, staff #1 pulls child #5 (20 month) upwards by both ankles causing child#5 lower back to come off the mat.

5- On October 23, 2023, in the toddler room at 11:40am, Staff #1 pulled child#6 (19 months) foot to move him/her, then pulled the child?s leg and arm in an upward motion to turn the child over and then the staff was observed picking the child up by the back of their neck and thigh, putting the child on his/her stomach.

6- On October 23, 2023 in the toddler classroom , at 11:49 Staff #3 pulled Child #7 (16 months) by one arm and the left leg to move the child closer.


7- On October 30, 2023, in the toddler classroom, at 11:03 am, Child #7 (17months) is picked up by their left elbow over the gate which measured to be 29 inches high. Staff #1 walks Child #7 with her legs and arms dangling to the mat for approximately 5 seconds. Staff #1 puts child #7 on the rest mat.

8- On October 30, 2023, in the toddler classroom, at 11:05 am Staff #1 picks child #5 up over the gate by both biceps with his back towards to staff #1 and drops child #5 down on his knees on his rest mat. Staff #1 picks up child #4 over the gate by the biceps and drops child #4 on mat in a forward motion.

9- On October 30, 2023, in the toddler classroom, at 11:06am, child #7 is on his/her rest mat and staff #1 picks child #7 up by the back of her pants and then picks her up by the right thigh and right bicep off the ground and puts her back on the mat.

10- On October 30, 2023, in the toddler classroom, at 11:11 child #7 is observed sitting up on her mat, staff #1 lifts her in an upward motion by her arm and leg to put her on the mat and pulled her leg and tossed a blanket on her.

11- On October 30, 2023, in the toddler classroom, at 11:11 child #4 is on the mat and Staff #1 lifted up the child by the ankle.

12- On October 30, 2023, in the toddler classroom, at 11:13 child #7 is on her rest mat. Staff #1 kicks child?s bottom with foot.

13- Center termination documentation completed on October 30, 2023, confirms the video footage shows Staff #1 carried a student across the room holding one arm and one leg: Roughly laying a child on mat: lifting child off her mat by the back of the pants and roughly forcing her to lay down; Grabbing child by one leg and one arm roughly for effort force her to lay down. Lifting another student by one arm and one leg and roughly placing him down on the mat.

Plan of Correction: Staff #1 was immediatley released on October 30, 2023 after reviewing camera footage from October 30, 2023. And the center conducted further investigation.

Vidoe footage and classroom are being reviewed often to make sure we are in compliance, keeping children safe and using the footage to determined additional training needed.

Educated the staff to properly use the gate and not pull children over the gate.

Staff have been given guidance that children are not required to fall a sleep during nap time/rest time but they can sit on there rest mats quitley. The Director has recommended for staff to have a quiet box so they have certain things to do during the naptime/rest time.

Also staff was given guidance that children can not be pick up by their limbs( this includes ankles, wrist , elbows etc..).

Standard #: 8VAC20-790-820-C
Description: Based on review of video footage and staff interview, the vendor did not ensure bottles used while the child is in his designated sleeping location.
Evidence:
1- On October 3, 2023, in the Toddler room at 11:47 am, child # 3 was sitting on her mat in her designated rest area drinking a bottle.

2- On October 30, 2023, in the toddler room at 11:09am, child #3 was observed laying on her rest mat in her designated rest area drinking a bottle.

Plan of Correction: Reviewed over the Subsidy requirements with all staff and explained that a child is not allow to have a bottle in there designated rest area that includes cribs, rest mats and cots.

This will be reviewed again during our Professional Devlopment Day in February.
