22.1 Early Childhood Care and Education

Comments:
This inspection was conducted by licensing staff both on-site and using an alternate remote protocol, including telephone contacts, documents review, interviews and a tour of the program.

A complaint inspection was initiated on 7/29/21 and concluded on 11/30/21. A complaint was received by the department on 7/29/21 regarding allegations in the area of children's injuries and was investigated jointly with the local agency. The center director was contacted by telephone to initiate the investigation. Interviews with staff were conducted both on-site and by telephone. Documentation and video footage related to the allegations was also reviewed. Information gathered during the investigation determined the complaint to be not valid; however, violations not related to the complaint were cited on the violation notice and were discussed with the center owner and director.

Description: Based on record review and interview, the center did not ensure that staff records contain written information to demonstrate that the individual possesses the education and experience required by the job position.

Evidence:
1. The records for staff 1 (date of hire: 6/30/21) does not contain documentation to demonstrate that they possess the education and/or experience required for the program leader position.
a. The center director stated that staff 1 was hired as a program leader.
2. The center director confirmed that the record for staff 1 does not contain documentation of education and/or work experience necessary for the qualification of program leader.

Plan of Correction: The center responded with the following: The director contacted staff 1 and requested a copy of her degree to show her education experience for qualifications as a Program Leader.

Complaint related: No
Description: Based on observation, it was determined that where playground equipment is provided, resilient surfacing shall comply with minimum safety standards when tested in accordance with the procedures described in the American Society for Testing and Materials standard F1292-99 and shall be under equipment with moving parts or climbing apparatus to create a fall zone free of hazardous obstacles.

Evidence:
1. The mulch surrounding the swings, slide and climbing equipment on the playground measured less than 1 inch in all areas, where 6 inches is required.
2. There was no resilient surfacing under the two tree swings on the playground. There were also tree roots sticking up from the ground under and around the tree swings.
3. The center director viewed the resilient surfacing in the fall zone for the play structures and confirmed that it was not compliant with the requirements in the standards of six inches of resilient surfacing.

Plan of Correction: The center responded with the following: 1. The contracting company that provides mulch for surfacing was contacted again to get an update on when mulch will be delivered to the center. 2. The tree swings were removed from the playground.

Description: Based on observation, the center did not ensure that the climbing portions of indoor slides and climbing equipment 36 inches or more shall be located over a resilient surface.

Evidence:
1. The back stage classroom contains a climbing structure that is approximately 90 inches in height. There was no resilient surfacing located under the climbing structure.
2. During the inspection, a child was observed climbing on the bars of the play structure.
3. The center director confirmed that there was no resilient surfacing under the climbing structure in the back stage classroom.

Plan of Correction: The center responded with the following: Resilient surfacing will be purchased and placed under the climbing structure.
