Comments:
A complaint inspection was initiated on 9/23/2022 and concluded on 9/26/2022 in response to a complaint that was received in the licensing office on 9/19/2022. The inspector reviewed compliance in the areas of administration, staffing and supervision, and programming. Observations were made in each classroom over a period of an hour and a half. Informal interviews were conducted with staff on site and staff schedules were viewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. The complaint was deemed to be valid.

Description: Based on observation and interview, the licensee did not ensure that when children are in ongoing mixed age groups, the staff-to-children ratio and group size applicable to the youngest child in the group shall apply to the entire group.

Evidence:
The inspector observed the following out of compliance ratio requirements at the center, in three separate classrooms, on 9/23/2022:

1. There were 6 infants, between 3 months and 16 months of age, present with 1 staff in Infant Room #1 when the inspector arrived at 8:33 a.m.

At 8:43 there were 7 infants present with 1 staff in Infant Room #1.

The ratio in infant room #1 remained at 7:1 until the Program Director arrived at the center at 9:02 a.m.

Based on the ages of the children in the mixed age group, there should have been at least 1 staff for every four children present.


2. There were 5 infants, between 3 months and 16 months of age, present with 1 staff in Infant Room #2 when the inspector arrived at 8:33 a.m.

At 8:43 a.m. there were 6 infants present with 1 staff in Infant Room #2.

The ratio in infant room #2 remained at 6:1 until the Program Director arrived at the center at 9:02 a.m.

Based on the ages of the children in the mixed age group, there should have been at least 1 staff for every four children present.


3. There were 13 children, between the ages of 1 year and 10 years old, to include 7 individual children who were under the age of 2 years old, present in the large preschool classroom with 1 staff at 8:40 a.m.

Based on the ages of the children in the mixed age group in the large preschool classroom, there should have been at least 1 staff for every 5 children.

The ratio the large preschool room remained at 13:1 until an additional staff arrived at 9:00 a.m. and took 5 children, all identified as being 1 year old, to the adjoining classroom.

4. The program Director confirmed that it is a routine practice to combine classrooms in the first part of the morning until more children and additional staff arrive.

Plan of Correction: The program director will submit a plan of correction within 5 days of receipt of the violation notice.
