22.1 Background Checks Code, Carbon Monoxide

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site renewal inspection was conducted on 6/7/24. The on-site inspection took place from 11:50 am to 12:30 pm. The inspector reviewed compliance in the areas listed above. There were 4 children present with one caregiver. The inspector reviewed 4 children and 4 caregiver/household member?s records. The inspection included document review, a tour of the daycare area, interviews, and observations.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.036-A
Description: Repeat background checks are required every five years.
There was no repeat central registry background check for household member A. The repeat background check was due by December 3 2023.

Plan of Correction: I requested this background check last month and I will call to check on the status.

Standard #: 8VAC20-800-60-B
Description: A child's record shall contain documentation of the review of the child's emergency contact information.
There was no annual review of the emergency contacts for child A, B, C and D.
Child A has been enrolled for 21/2 years without an update review, child B has been enrolled for 1 1/2 years without an update review, child C has been enrolled for over 2 years without an update review and child D has been enrolled for 2 1/2 years without ab update review.

Plan of Correction: I will obtain any updates and have the parents sign off on the form.
