Comments:
A code compliance inspection was conducted on May 15, 2023 from 1:00 PM to 2:40 PM. There were thirty-four children present, ranging in ages from two years to four years, with four staff supervising. The inspector reviewed compliance in the areas of supervision, procedures, physical plant and staff records. A total of six staff records were reviewed. Information gathered during the inspection determined non-compliance(s) with applicable code sections and violations were documented on the violation notice issued to the program.
Based on observation, facility did not ensure required document is posted.
Evidence: The facility's written exemption was not posted in a visible location.

Exemption letter will be located and posted at the entrance.

Based on review, facility did not ensure 1 of 6 staff records has required documentation from a practicing physician or physician assistant.
Evidence: The record for staff #6 did not have documentation from a physician or physician assistant stating the individual was free from any disability which would prevent him/her from caring for children under their supervision.

Staff has an appointment scheduled for May 30th.

Evidence: Documentation related the child day center's physical facilities, enrollment capacity, food services, health requirements for the staff and liability insurance was not made available to the general public.

Description:
Based on review, facility did not ensure out of state background checks are completed when an individual has lived outside the state of Virginia within the past 5 years.
Evidence: The record for staff #3 had documentation dated 1/26/2023 that the individual has lived outside the state of Virginia within the past 5 years and there was not background checks completed for those states.
Plan of Correction:
Background checks will be initiated today.
