The Inspector provided written documents: * 2020 legislative implementation with emphasis on new out-of-state background check requirements effective July 1, 2020. **Effective July 1, 2020 the results of out-of-state criminal record checks and sex offender checks must be obtained prior to employment or volunteer service.
Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A code compliance inspection was initiated on 02/09/2021 and concluded on 02/11/2021. The director was contacted by telephone to initiate the inspection. There were 72 children present and 17 staff. The inspector emailed the director a list of items required to complete the inspection. The inspector reviewed five staff records submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliance with applicable code sections and violations were documented on the violation notice issued to the facility.
The licensing inspector has reviewed with the director COVID-19 Essential Guidance for Child Care programs.
Based on record review and interview, the religiously exempt child day center failed to obtain a copy of the results of a criminal history record information check from any state in which the applicant has resided in the preceding five years prior to employment.
1. The results of a criminal record check from the State of California were not on file for staff 1. a. Staff 1 has a hire date of 11/18/2020 and has resided in the State of California within the past five years. 2. The results of a criminal record check, from the State of Mississippi, were not on file for staff 2. a. Staff 2 has a hire date of 08/24/2020 and has resided in the State of Mississippi within the past five years.
Plan of Correction:
1. For staff 1 a criminal record check has been requested from the State of California. 2. For staff 2 a criminal record check has been requested from the State of Mississippi.
Going forward the results of out-of-state background checks will be obtained prior to employment.
