This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A complaint inspection was initiated on 4/8/20 and concluded on 8/3/20. A complaint was received by the department regarding allegations in the area of behavior guidance and was investigated jointly with the local agency. The director was contacted by telephone to conduct the investigation. Interviews with staff and collaterals were conducted by telephone and documents related to the incident were reviewed. The evidence gathered during the investigation supported the allegation of non-compliance with standards or law and a violation was issued in the area of programs.
Based on interviews, the center did not ensure that behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.
Evidence: 1. The parent of child 1, age 3, reported that on 4/6/20, her daughter told her that staff 1 grabbed her arm during nap time. The parent stated that her daughter had three scratch marks on her right forearm. 2. Staff 2 (center director) stated that staff 1 had called her into the pre-k classroom during nap time on 4/6/20 due to behavioral issues with child 1. Staff 2 stated she noticed scratch marks on child 1's arm and that child 1 told her that staff 1 had tried to take a toy away from her and grabbed her arm. 3. Staff 2 stated that staff 1 told her that child 1 had "smacked" her and that her first reaction was to "grab" the child's arm.
Plan of Correction:
The facility responded with the following: After review of situation, we terminated staff member with FD. Also reviewed during staff meeting child guidance behavior tips.
